Facilitative mediation – describing the elephant

I am often asked what mediation is, how it works, and why it works. Answering this question reminds me a bit of John Godfrey Saxe’s poem, “The Blind Men and the Elephant”. Everyone has their own understanding of what mediation is just as the six blind men in Saxe’s poem had six different descriptions of an elephant. John Abbott, Silverman Sherliker’s Head of Dispute Resolution, explains the value of mediation as an alternative means of resolving legal disputes.


Intellectual property scam results in record £500,000 fine

The Intellectual Property and Enterprise Court (IPEC) has recently handed down its maximum fine to Intellectual Property Agency Limited (IPAL) and Harri Mattias Jonasson. The company, controlled by Jonasson, routinely sent out huge numbers of ‘renewal reminders’ to legitimate owners of registered trademarks and patents. These renewals were posted well in advance of the necessary date and quoted vastly inflated fees. Robert MacGinn explains how the law came down on the perpetrators, and why brand owners must remain alert.
