Silverman Sherliker launch prenuptial agreements website

Something like 50 per cent of all marriages in the UK end in divorce and quite often the court divides the assets of the marriage on a 50:50 basis.

However, couples can enter into a prenuptial agreement ahead of getting married, under which they agree what assets are to be taken into account by the court on any divorce.

 

Recent cases in the High Court show that it is not only becoming much more fashionable for couples to sign a prenuptial agreement before getting married but also that the courts are much more disposed to enforcing the terms of the agreements when splitting assets on any subsequent divorce.

Family law partner Maeve O’Higgins says “The courts will now consider the terms of a prenuptial agreement, provided it has been properly entered into and also provided that enforcing the provisions will not cause undue hardship to the parties or to any children of the marriage.

“Amongst other things, it is crucial for both parties to be independently advised and there needs to be full disclosure of assets. It is a particularly useful step where there is a large disparity between the financial circumstances of the parties to the marriage and is very popular with people who have already been divorced before and are re-marrying”.
